On June 25, 2021, letters were sent to Jennifer and Amanda Bacolas from attorney Barbara S. Harper, but those were also ignored.

In order to avoid a civil action against the State of Arizona for gross misconduct with the improper removal of my children from my care, your agency conducted a smear campaign against my reputation as a heavily vetted father and behavioral health provider in the State of Arizona.

Your department had no case of parental maltreatment of his children, as reflected in the false pleadings and erroneous first severance that is already documented in 2019.

When I was preparing for a return of my children in 2020, your department, under the direction and supervision of Michael Faust, conducted a smear campaign against me in order to prejudice the Juvenile Court in support of a second illegitimate severance in 2020, with the intent to only rob me of the right to possess my children, so I would be barred from seeking civil restitution for the misconduct of your department. My treatment by your department exposed a high level of institutional corruption that is despicable, to put it mildly.

Knowing the state had absolutely no case to show just cause to justify a second severance, as no evidence was presented in the first severance that was not fraudulent, as the pleadings were in "error", using the semantics of the Assistant Attorney General who was tasked with protecting the state's interests.

Your illegitimate second severance had no evidentiary support, but rested solely on the rants of SMI adults suffering on the spectrum of extreme of narcissism themselves, inheriting brain abnormalities from their mother, and those are documented with the Washington School District in Phoenix, Arizona, and are documented with DCS, unless those files are corrupted like everything else in your department.

In September, 2021, Michael Robertson contacted a New York lawfirm that specializes in pre-litigation in prima facie tort actions, and specifically, the violations and tortuious injuries cased to this parent by the State of Arizona and the Department of Child Safety. severance of his parenting rights and the resulting adoption of  

his two minor children. 

The causes of action of which our client seeks resolution  

includes, but are not limited to: 1) civil rights violations of  

a protected person with an identified disability under the  

Americans with Disabilities Act (ADA); 2) violations of his  

civil and due process rights guaranteed under the Constitutions  

of the United States of America and the State of Arizona; 3)  

tortious interference with parental rights; 4) tortious  

interference with parental visitation; 5) alienation of  

affections; and 6) intentional infliction of emotional distress. 

The evidence cited herein was presented to our firm on a  

list of exhibits for litigation that is forthcoming in these 

several matters, and in the possession of our client, Michael  

Robertson.

Please be clear, litigation on these several matters is  

forthcoming. 

Mr. Robertson has retained our firm to negotiate a  

settlement to spare him and his children the psychological  

trauma associated with litigation in these several matters, the  

injuries he experiences on a daily basis due to the continued  

separation from his children, and to avoid the bad PR and a  

civil award for damages to our client that such litigation would  

bring to your department and the State of Arizona, should your  

departments conduct be exposed in the gross violation of our  

clients civil and due process rights. 

In consideration of the foregoing, our client presents the  

following settlement proposal: 

1. The adoption in this dependency will be reversed and  

the minor children immediately returned to the custody and care  

of Michael Robertson. 

2. DCS supervisor Joelle Higby, case manager Lisa  

Millett, and investigator Patricia Smith will be immediately  

terminated as employees of the Arizona Department of Child  

Safety, to preclude them from violating other parents’ rights in  

the State of Arizona. They will be terminated and not eligible  

for rehire with any state agency in Arizona, so they will not be  

able to use DCS as a reference in child protective service  

agencies in the United States, where their behaviors could put  

other families at risk.

3. The minor children will be returned to the care and  

custody of Michael Robertson without condition or participation  

in any reunification services through the Arizona Department of  

Child Safety. 

4. Michael Robertson will sign a non-disclosure agreement  

not to discuss or publish any information regarding his abuses  

with the Arizona Department of Child Safety, the Office of the  

Arizona Attorney General, The State of Arizona, or any and all  

agencies, public or private, associated with this dependency  

matter. 

5. Michael Robertson will sign a release of liability  

waiver, barring him from future seen or unseen causes of action  

against the Arizona Department of Child Safety, the State of  

Arizona, and the Office of the Arizona Attorney General for any  

damages stemming from this dependency with him and his minor  

children. 

6. As part of the conditions of the non-disclosure  

agreement, Michael Robertson will dissolve the non-profit  

corporation organized in the State of Arizona, Arizona Advocacy  

Foundation for Victims of DCS Corruption, and permanently remove  

from the internet the website, https://arizonadcscorruption.com. 

7. Michael Robertson will sign a waiver that upon  

graduation from law school with his Juris Doctor degree in 2024,  

that he will not represent any cases where the Arizona  

Department of Child Safety is a respondent or defendant, he will  

not provide expert witness testimony for such cases where DCS is  

a respondent or defendant, and he will not work in any legal  

support capacity for any such litigation. 

In a full review of the list of evidence our client has in  

his possession and the egregious misconduct of the employees of  

the Arizona Department of Child Safety in this dependency, it is  

more than likely he will prevail when these several causes of  

action goes to litigation, and it is also more than likely DCS  

and the State of Arizona will not prevail in a defense of these  

matters. 

The psychological well-being of our client and his children  

far outweighs any civil remedies he will more than likely be  

awarded in these several prima facie causes of action. 

Please take a moment of your time to familiarize yourself  

with Mr. Robertson and his two children. 

Our client has agreed to allow you a reasonable response  

time to review Mr. Robertson’s 23 year case history with DCS,  

the false pleadings that were filed in this dependency, and time
